Article 1: General provisions

The e-commerce website of Visualbaitboats, a sole proprietorship with registered office at Moutstraat 20, 9000 Ghent BE0740539273 offers its customers the possibility to purchase the products from its web store online.

These General Terms and Conditions apply to every order placed by a visitor to this e-commerce website ("Customer"). When placing an order via the Visualbaitboats web store, the Customer must explicitly accept these Terms and Conditions, thereby agreeing to the applicability of these Terms and Conditions, excluding all other terms and conditions. Additional terms and conditions of the Customer are excluded, unless these have been accepted in advance by Claerman Johan (owner) in writing and explicitly.

Article 2: Price

Article 3: Offer

Obvious mistakes or errors in the offer do not bind Visualbaitboats. Visualbaitboats is, as far as the accuracy and completeness of the information is concerned, only bound to an obligation of means. If the Customer has specific questions about, for example, sizes, color, availability, delivery time or delivery method, we ask the Customer to contact our customer service in advance.

The offer is always valid while supplies last and can be adjusted or withdrawn at any time by Visualbaitboats. Visualbaitboats cannot be held liable for the unavailability of a product. If an offer has a limited duration or is subject to conditions, this will be explicitly stated in the offer.

Article 4: Online purchases

Visualbaitboats is entitled to refuse an order due to a serious shortcoming on the part of the Customer with regard to orders in which the Customer is involved.

Article 5: Delivery and implementation of the agreement

Items ordered through this web store are delivered throughout Europe

The delivery is made by different transport companies and the price depends on the quantity of items ordered. As soon as we receive an order, it is prepared fresh daily and sent to the customer as soon as possible.

Unless otherwise agreed or expressly determined otherwise, the goods will be delivered to the Customer's place of residence within 30 days of receiving the order.

Any visible damage and / or qualitative shortcoming of an item or other shortcoming in delivery must be reported by the Customer to Visualbaitboats without delay.

The risk of loss or damage is transferred to the Customer from the moment he (or a third party designated by him, who is not the carrier) has physically taken possession of the goods. However, the risk is already transferred to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by the Visualbaitboats.

Article 6: Retention of title

The delivered items remain the exclusive property of Visualbaitboats until the moment of full payment by the Customer.
The Client undertakes, if necessary, to remind third parties of the reservation of ownership of Visualbaitboats, for example to anyone who would come to seize the articles that have not yet been fully paid.

Article 7: Right of withdrawal

-The provisions of this article only apply to customers who purchase articles online at Visualbaitboats in their capacity as consumer.
-The Client has the right to withdraw from the contract within 14 calendar days without giving any reason.
-The withdrawal period expires 14 calendar days after the day on which the Client or a third party designated by the Client, who is not the carrier, physically acquires the last good.
-To exercise the right of withdrawal, the Client must inform Visualbaitboats, Moutstraat 20, 9000 Ghent, visualbaitboats@gmail.com +32493 37 90 50 an unambiguous statement (eg in writing by mail, or an e-mail) of his decision to withdraw from the contract.
-The Client can use the model withdrawal form for this, but is not obliged to do so.

-This form can be found here.To comply with the withdrawal period, the Client must send his notification of his exercise of the right of withdrawal before the withdrawal period has expired.

-The Customer must return the goods to Visualbaitboats without delay, but in any case no later than 14 calendar days after the day on which he communicated his decision to revoke the agreement to Visualbaitboats, Moutstraat 20, 9000 Ghent

-The Customer is on time if he returns the goods before the period of 14 calendar days has expired. The direct costs of returning the goods are for the account of the Customer.

-The costs are estimated at a maximum of around 10EUR for shipments from Belgium. If the returned product is in any way diminished in value, Visualbaitboats reserves the right to hold the Customer liable and claim damages for any depreciation of the goods that results from the use of the goods by the Customer that goes beyond what is necessary to determine the nature, characteristics and operation of the goods.

-Only articles that are in the original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be taken back.

-If the Client cancels the agreement, Visualbaitboats will reimburse all payments received up to that point, including the standard delivery costs, to the Client within a maximum of 14 calendar days after Visualbaitboats has been informed of the Client's decision to terminate the agreement to revoke.

- With sales agreements, Visualbaitboats can wait with the reimbursement until he has received all the goods, or until the Customer has demonstrated that he has sent back the goods, whichever is the earlier. Any additional costs resulting from the Customer's choice for a different method of delivery than the cheapest standard delivery offered by Visualbaitboats will not be reimbursed.

-Visualbaitboats pays the Customer back with the same payment method with which the Customer has carried out the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not be charged for such reimbursement.

-If goods have been removed from their packaging and used, for example, return is no longer possible.

Article 8: Warranty

Under the law of 21 September 2004 on the protection of consumers when selling consumer goods, the consumer has legal rights. This legal guarantee applies from the date of delivery to the first owner. Every commercial guarantee does not affect these rights.

To invoke the guarantee, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the Client's home, the Client must contact Visualbaitboats customer service and return the item to Visualbaitboats at its expense.

When a defect is determined, the Customer must inform Visualbaitboats as quickly as possible. In any case, any defect must be reported by the Customer within a period of 2 days after it has been determined. Afterwards, any right to repair or replacement expires.

The (commercial and / or legal) guarantee never applies to defects that arise as a result of accidents, neglect, falls, use of the item contrary to the purpose for which it was designed, non-compliance with the instructions for use or manual, adjustments or changes to the item, heavy use, poor maintenance, or any other abnormal or incorrect use.

Defects that manifest themselves after a period of 5 days following the date of purchase, delivery, if any, are considered not to be hidden defects, unless the Customer proves otherwise.

Article 10: Penalties for non-payment

Without prejudice to the exercise of other rights held by Visualbaitboats, in the event of non-payment or late payment from the date of the default, the Customer owes an interest of 10% per year on the unpaid amount without notice. In addition, the Customer is legally and without notice required to pay a lump sum compensation of 10% on the amount in question, with a minimum of 25 euros per invoice.

Without prejudice to the foregoing, Visualbaitboats reserves the right to take back articles that are not (fully) paid.

Article 15: Proof

The Client accepts that electronic communications and back-ups can serve as evidence.

Article 16: Applicable law - Disputes

Belgian law applies, with the exception of the provisions of private international law regarding applicable law.

The courts of the place of residence of the Consumer are competent in legal disputes. The Consumer can also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).
